Who Can apply for Refugee Status?

To make a refugee claim, you

• Must be in Canada;
• Can’t be subject to a removal order.

You may apply for refugee status if you fall under one of the two following categories:

Convention Refugees

• religion
• political opinion
• nationality
• being part of a social group, such as women or people of a particular sexual orientation

A Person in Need of Protection

• danger of torture
• risk to their life
• risk of cruel and unusual treatment or punishment

What is the Application Process?

You must submit your application through the online refugee portal. The application involves various questions such as your background information and the reasons for why you fled your home country. It is important that the application is completed in a manner that they will be helpful to you during your hearing. The information in your application forms can be raised during your refugee hearing.

When can I make my Refugee Claim?

You can make a refugee claim either at the port of entry (you came in at a land border, airport or seaport), or you can choose to make your claim after your arrival in Canada at a later date.

What is the Refugee Process in Canada?

• The Applicant completes the application package through the online portal.
• The Applicant will receive an acknowledgment of refugee claim.
• The Applicant will be contacted to attend an eligibility hearing. The eligibility hearing is conducted with the purpose of weeding out fraudulent claims
• After your eligibility interview you will receive a confirmation of referral and obtain refugee claimant status. You will be provided with a date for your refugee claim.

Can I work while I wait for Refugee Status?

Yes. After your eligibility interview, you will be eligible for an open work permit.
