pre removal risk assessment

If you’ve been ordered to leave Canada, you may have one last opportunity to stay through a pre removal risk assessment (PRRA). This process allows individuals facing removal to explain why they would be at risk if returned to their home country. Understanding who is eligible to apply is crucial if you’re considering this option.

What is a Pre-Removal Risk Assessment?

A PRRA is a process offered by Immigration, Refugees and Citizenship Canada (IRCC) to individuals who have received a removal order. It assesses the risks you may face in your home country, including:

  • Danger of torture
  • Risk to life
  • Risk of cruel and unusual treatment or punishment

If your application is accepted, you may be able to remain in Canada as a protected person.

Who Can Apply?

Not everyone ordered to leave Canada is eligible to apply immediately for a PRRA. You cannot apply if you:

  • Made a refugee claim within the last 12 months that was rejected, abandoned, or withdrawn.
  • Had a previous PRRA decision within the past 12 months.

Exceptions may apply if circumstances in your home country have changed significantly or if you have new evidence of risk that wasn’t previously considered.

Because of these limitations, it’s critical to act quickly and seek legal advice to determine your eligibility and prepare a strong application.
