The application must be filed within 15 days of being notified of the refusal if you are in Canada (60 days if you are outside Canada), and only a lawyer can represent you there. This guide uses Nova Scotia certificates as an example, but we review refusals involving certificates from British Columbia, Alberta and other provinces too.

Lawgical Law Corporation, an immigration law firm in Surrey, Abbotsford and Vancouver, BC, challenges these CoQ refusals in the Federal Court for Express Entry applicants across Canada; this guide is by Sundeep S. Grewal.

What does a CoQ refusal under 11.2(1)(b) say?

In these refusals, the officer accepts that you hold a provincial pesticide certificate and that NOC 73202 (Pest controllers and fumigators) is on IRCC’s list of eligible trade occupations. The officer then finds that the certificate mainly authorizes you to apply pesticides and is not a certificate of qualification in a trade under section 26 of the Ministerial Instructions respecting the Express Entry system. The officer removes the points, finds that your score is now below the cut-off for your draw, and refuses the application under paragraph 11.2(1)(b) of the Immigration and Refugee Protection Act.

You will often see phrases like these in the Officer Decision Notes:

“A certificate and CoQ do not necessarily serve the same regulatory purpose”

the certificate serves “primarily as authorization to engage in a regulated activity”

“the inclusion of an occupation on that list does not, on its own, establish that a particular document constitutes a CoQ”

Other wording that appears in these Officer Decision Notes (ODN):

a credential “may be described as a ‘certificate of qualification’ within a particular regulatory scheme”

“insufficient evidence to establish that” the province “considers this credential to be a trade certification comparable to a skilled-trade CoQ for the purposes of section 26 of the Ministerial Instructions”

“I am rejecting the CoQ” from the application

“a loss of points that brought the PA’s rank below the lowest ranking person who was invited to apply”

In other words, IRCC has removed CRS points after the invitation to apply (ITA), and without those points you no longer ranked high enough for your draw.

Why this refusal needs a lawyer

One lawyer, one file, every step:

reviewing the refusal and the officer’s notes;

filing the judicial review within the deadline (15 days in Canada, 60 outside);

arguing it in the Federal Court;

a new Express Entry profile or application, if that turns out to be the faster route.

A refusal like this turns on statutory interpretation and administrative law: reading federal immigration rules alongside provincial legislation, applying the Vavilov standard, and dealing with cases like Singh. That is the work lawyers are trained and licensed to do.

Immigration lawyers are members of a provincial law society (in our case, the Law Society of British Columbia) and can represent you in the Federal Court. Under the Federal Courts Rules, a person in a court proceeding may act on their own or be represented by a lawyer, so an immigration consultant cannot take your refusal there.

Some articles about these refusals mention judicial review as an option. A consultant cannot file or argue one, so it would have to be handed to a lawyer, with the 15-day clock already running. If judicial review is the realistic fix, it saves time to start with a lawyer.

What are my options after a CoQ refusal?

Read the Officer Decision Notes carefully. They show exactly how the officer reasoned and which documents were considered.

Reconsideration request. You can ask IRCC to reconsider, but it is discretionary and does not stop the court deadline from running.

Judicial review in the Federal Court. You must file within 15 days of being notified of the decision if you are in Canada (60 days if outside), under section 72 of the Act. The Court first decides whether to grant leave (permission) to hear the case. If it finds the decision unreasonable, it usually sends the application back to a different officer to decide again.

A new Express Entry profile without the certificate points, if your score would still be competitive.

The court deadline does not wait for the other options.

Could the refusal be challenged in court?

The strongest argument, in our view, is that the officer drew a distinction between “authorization to practise” and “recognition of qualification” without adequately explaining it, when Nova Scotia’s certification scheme appears to do both.

Authorization and qualification are not opposites. A certification scheme can test the knowledge a job requires and then authorize the people who pass to do that job. IRCC’s own guidance says a certificate of qualification “proves you’re qualified to work in a certain skilled trade,” that holders have passed a certification test, and that they meet the rules for practising in the province that issued it. The fact that a certificate also works as a licence does not, by itself, explain why it should be excluded.

In the refusals we have reviewed, the officer describes what a certificate of qualification does with words like “such as” demonstrating competency or completing apprenticeship or training requirements. The officer does not then explain why Nova Scotia’s examination-based scheme falls short of that description, or why designation under the province’s apprenticeship system should be required under the federal wording.

Under Canada (Minister of Citizenship and Immigration) v. Vavilov, 2019 SCC 65, a decision must be justified, transparent and intelligible in light of the law and the evidence. The argument is not that a pesticide certificate automatically earns 50 points. It is that the officer’s reasons did not justify the distinction against the legislation, the examination requirements, the national standard and the federal classification of the occupation.

Whether this argument fits your case depends on your certificate class, the work it covers, your evidence and the exact wording of your Officer Decision Notes. Any procedural fairness issue, such as whether the officer should have raised the concern with you first, is a separate question that depends on your file.

What do the Express Entry rules require?

Section 26 of the Ministerial Instructions awards points for “a certificate of qualification in a trade occupation issued by a competent provincial or federal authority.” With strong English or French results (CLB 7 or higher in every skill), it is worth 50 points in Express Entry.

The wording does not expressly limit qualifying certificates to those issued under provincial apprenticeship legislation. It does not require an apprenticeship or a particular training pathway, and it does not set a separate test of comparison with an apprenticeship-based credential. An officer can still examine whether a particular certificate meets the requirement, but the reasons must say what the certificate lacks and how that conclusion follows from the rules.

How does Nova Scotia certify pesticide applicators?

Nova Scotia’s Pesticide Regulations, made under the Environment Act, set up a full certification scheme:

a person may not apply commercial or restricted pesticides without a valid certificate of qualification (s. 6(1));

the province issues defined classes of certificate, including structural pest control and fumigation (s. 7(1));

an applicant must score at least 75% on the examination before a certificate is issued (s. 8(2));

the regulations deal with validity, retesting and the work each class authorizes (ss. 8(3)–(5)), and with supervision of uncertified workers (s. 9).

The province’s certification program is based on the National Standard for Pesticide Education, Training and Certification in Canada. Most classes require both a core examination and a class-specific examination, and renewal is by examination or continuing education.

Pest control and fumigation are not on the Nova Scotia Apprenticeship Agency’s current published list of designated trades. Nova Scotia regulates pesticide applicator certification separately, under the Environment Act and the Pesticide Regulations.

How is this different from the Singh truck driver case?

In Singh v. Canada (Citizenship and Immigration), 2026 FC 892, the Federal Court upheld the removal of 50 points from a truck driver who relied on his Ontario Class AZ licence and his Mandatory Entry-Level Training certificate. The Court accepted that in Ontario only Skilled Trades Ontario may issue certificates of qualification, and that it does not issue them to truck drivers. The applicant did not claim to hold one, and he gave the Court no legal authority for treating a driver’s licence or a training certificate as a certificate of qualification. His occupation had also been removed from IRCC’s list of eligible occupations before his decision.

A Nova Scotia pesticide certificate is in a different position:

It is a certificate of qualification under provincial law. The Pesticide Regulations themselves create it and call it that.

It is issued only after examination to a national standard, with a 75% passing mark.

The occupation is still on IRCC’s eligible list. Pest controllers and fumigators (NOC 73202) sit in the federal classification’s “General trades” group, and the classification lists a provincial pesticide applicator licence as an employment requirement. It does not describe apprenticeship as the only way into the work.

Singh does show that the Court expects applicants to point to the legislation behind their certificate, and that IRCC’s own instructions to officers will matter. That is why these cases need careful legal argument, not just disagreement with the officer.

Refused with a BC, Alberta or other provincial certificate?

We review these refusals too, including BC Pesticide Applicator Certificates, Alberta pesticide applicator certificates and Ontario exterminator licences. Each province regulates pesticide applicators under its own legislation, so the argument has to be built on your province’s scheme. We compare your certificate and the legislation behind it with the officer’s reasons, and tell you whether a court challenge is realistic.

What should I do right now?

Note the date you were notified of the refusal, and gather the refusal letter, the Officer Decision Notes, your certificate and your application documents. Then get legal advice quickly; fifteen days passes fast.

Book a consultation with our immigration lawyers in Abbotsford, Surrey or Vancouver to review your refusal and the deadline that applies to you.

This article is general information, not legal advice.
