A mandamus<\/strong> application, often called a writ of mandamus, asks the Federal Court to order IRCC to decide your application. It is worth considering when your file has been waiting far longer than normal, the delay is not your fault, and IRCC has given no good reason for it. It can force a decision, not an approval.<\/p>\n

What mandamus is<\/h2>\n

Mandamus is a court order requiring a government decision-maker to carry out a legal duty. In immigration, the duty is usually to decide an application that has been properly made. Mandamus is a type of judicial review, so you first need the court’s permission (“leave”) under section 72 of the Immigration and Refugee Protection Act<\/em>.<\/p>\n

The test the court applies<\/h2>\n

The Federal Court applies a set of conditions for mandamus. For delay cases, three questions usually decide the outcome:<\/p>\n

  1. Is the delay longer than normal?<\/strong> The wait must be longer than the nature of the process reasonably requires. There is no fixed number of months.<\/li>\n
  2. Did you cause any of it?<\/strong> You and your representative must not have caused or added to the delay, for example by missing a request for documents.<\/li>\n
  3. Does IRCC have a good explanation?<\/strong> Ongoing security or admissibility checks can be a satisfactory explanation, at least for a while.<\/li>\n<\/ol>\n

    You must also show IRCC owes you a duty to decide, and that you have met the requirements so the file is ready for a decision.<\/p>\n
